Driver Terms

Version 1 · Effective 2 November 2026

These terms are between HAULY LTD (company number 17493122, registered in England and Wales, registered office 718 Marsden House, Marsden Road, Bolton BL1 2JX; trading address Unit 56, Compass Park, Liverpool L24 1YA) ("Hauly", "we", "us") and you, the independent driver or courier who uses the Hauly app or website ("you"). Please read them carefully. By accepting them you agree to be bound by them.

Key points

  • You run your own business. You are not an employee or worker of Hauly. You choose which jobs to accept, when to work, and whether to work for others.
  • You must hold a valid licence, the right to work in the UK, a roadworthy vehicle and in-date hire-and-reward and goods-in-transit insurance.
  • Hauly collects payment from customers and pays you the job fee shown when you accept a job. Payment is released after a hold period (currently 7 days) and is subject to set-off for refunds, claims and chargebacks.
  • You are responsible for goods in your care and you indemnify Hauly for loss and damage you cause.
  • Hauly may suspend or remove your access to the platform for the reasons in clause 9, with notice and a chance to respond, except in urgent cases.

1. About these terms

1.1 These terms apply from the date you accept them. We keep a record of the version you accepted, the date and time and the device or location you accepted from.

1.2 Some work offered through Hauly (such as programme or partner routes) has extra terms. If those extra terms conflict with these terms for that work, the extra terms win for that work.

1.3 If you worked with Hauly before 1 October 2026, you worked with the person who then operated the Hauly service. From the date you accept these terms, your relationship continues with Hauly Ltd, which has taken over that service. Jobs you completed before you accepted these terms stay subject to the arrangements that applied at the time.

2. Your status

2.1 You are an independent contractor running your own business. Nothing in these terms makes you an employee, worker, partner or agent of Hauly, and you are not entitled to holiday pay, sick pay, pension contributions or other employment benefits from Hauly.

2.2 You decide whether to accept any job. We do not promise you any minimum amount of work, hours or earnings. You may decline a job without giving a reason and without any penalty, and you may work for other businesses, including our competitors, at any time.

2.3 You decide how to perform each job, subject to the job instructions, safety rules, the law and the standards in clause 4.

2.4 You provide your own vehicle, fuel, equipment, phone and insurance, and you are responsible for your own costs, tax and National Insurance contributions. You are responsible for registering as self-employed and for any VAT registration you need.

2.5 If a tax authority or court decides that you are not self-employed, you and Hauly will each take reasonable steps to put each other in the position you would have been in if that had not happened, to the extent the law allows. This does not mean either of us accepts that you are not self-employed.

3. Who can use the platform

3.1 To use the platform and to keep your access, you must:

  • be at least 18 and have the right to work in the United Kingdom;
  • hold a full, valid driving licence appropriate to your vehicle;
  • have a roadworthy vehicle with a current MOT (if required) and vehicle tax, registered in your name or one you are entitled to use for work;
  • hold hire-and-reward insurance and goods-in-transit insurance that is in force and covers the type of jobs you accept, with a limit of cover that is enough for the goods you accept. We may notify you of a minimum cover level, in which case you must meet it; and
  • give us accurate information and keep your documents and details up to date.

3.2 We hold copies of the documents you upload. We may check them, but our checking is for our own purposes only. It is not a guarantee to you or to anyone else that your documents are valid, and it does not remove your own responsibility to comply with this clause.

3.3 You must tell us immediately if your licence, insurance or right to work lapses or is restricted, or if you are charged with or convicted of a motoring offence that affects your licence or an offence involving dishonesty or violence. If any required document lapses, we may suspend your access to the platform until you provide a valid replacement.

4. Jobs

4.1 Jobs are offered through the app. The offer shows the collection and delivery locations, the job fee and any special requirements. When you accept a job you agree to do it on those terms.

4.2 Once you accept a job you must complete it, or tell us as early as possible if you cannot. You may send an approved substitute under clause 5.

4.3 On every job you must:

  • collect and deliver the goods safely and on time, with reasonable care;
  • follow the instructions in the job and any lawful instruction from the customer or recipient about access and handover;
  • take the proof of delivery the app requires (such as a photograph, signature or recipient name) before you leave;
  • refuse and report any item that is on the prohibited list for customers, is unsafe, is not as described or is not properly packed;
  • not open, tamper with, use, sell or keep any goods, and not leave goods unattended in an unsafe place;
  • not carry passengers, and not carry other people's goods in a way that creates a risk to the customer's goods;
  • comply with road traffic law, parking rules and any other law that applies to you and your vehicle; and
  • behave courteously and professionally with customers, recipients and Hauly staff.

4.4 You are responsible for any fine, penalty or charge arising from your driving or your vehicle, including parking fines, speeding fines and any Congestion Charge or tolls not shown on the job as a pass-through payment to you.

5. Substitutes

5.1 You may send another person to do an accepted job in your place, if you tell us beforehand (by emailing [email protected], or through the app where that option is available) and the substitute meets our requirements in clause 3 (licence, right to work, vehicle and insurance) and has been approved by us. The substitute either has their own approved Hauly account or is approved by us in writing for that job.

5.2 We will approve a substitute who meets those requirements. We will not unreasonably refuse or delay approval.

5.3 You remain responsible to us for the job being done to the standard in clause 4, and you are responsible for paying the substitute. We will pay the job fee to you.

6. Job fees and payment

6.1 The job fee is shown when you accept a job. Hauly sets the price that the customer pays; the job fee is the amount we pay you for the work. Pass-through charges such as the London Congestion Charge, tolls or fuel are passed to you at cost where the job shows them.

6.2 Hauly takes the customer's payment. We pay you the job fee through our payment provider, Stripe. You must complete Stripe's onboarding, and you accept Stripe's connected-account terms. We are not responsible for Stripe's actions.

6.3 Hold period. The job fee becomes releasable after a hold period starting from the date your proof of delivery is captured (or, if none is captured, the date of delivery). The hold period is currently 7 days. We may change it on notice, but it will never be shorter than 7 days. The hold exists to cover refunds, chargebacks and claims, and is released by Hauly. We aim to release payment promptly once it is due.

6.4 Set-off. We may deduct from any amount we owe you (including held amounts and future job fees) any amount you owe us under these terms, including for refunds to customers, chargebacks and claims for goods you lost or damaged, any amount we have paid because of your breach, and any fine or charge we paid for you.

6.5 If a customer's payment is refunded, reversed or charged back, we may reverse or claw back the job fee for that job.

6.6 You are responsible for any tax on what you earn. If we are required by law to deduct or report anything, we will do so.

7. Goods in your care and indemnity

7.1 From collection until proof of delivery, you are responsible for the goods. If goods are lost, damaged or stolen while in your care because of your act or omission, you will pay Hauly the cost we are liable to pay the customer, and our reasonable costs.

7.2 You will indemnify Hauly against any loss, damage, claim, liability, cost or expense (including reasonable legal costs) that Hauly suffers arising from your breach of these terms, your negligence, your fraud or dishonesty, the loss of or damage to goods in your care, or any claim by a third party arising from how you do a job.

7.3 Your insurance does not limit your responsibility under this clause. You must keep your insurance in force and claim on it where appropriate.

8. Hauly's responsibility to you

8.1 We provide the platform on an "as available" basis. We do not guarantee that it will be uninterrupted or error-free.

8.2 We are not responsible for: loss of earnings or opportunity from a job not being offered, a job being cancelled or the platform being unavailable; loss of or damage to your vehicle or equipment; or any indirect or consequential loss.

8.3 Our total liability to you for anything arising from these terms, other than for fees we owe you, will not exceed the job fees paid or due to you in the 12 months before the claim arose.

8.4 Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited or excluded.

9. Platform access

9.1 We may warn, restrict, suspend or remove your access to the platform for a good reason. Good reasons include:

  • repeatedly failing to complete jobs you have accepted without telling us in good time;
  • a lapsed or false document, licence, insurance or right to work;
  • loss, damage or theft of goods, or evidence of dishonesty;
  • unsafe or unlawful driving or behaviour;
  • abusive or threatening conduct to customers, recipients or Hauly staff;
  • unauthorised use of the platform, another person's account, or sharing your account with another person;
  • repeated customer complaints that we have investigated;
  • using customer information for any purpose other than the job; and
  • any other serious breach of these terms.

9.2 Before we remove your access, we will normally tell you the reason, give you at least 3 working days to respond, and consider what you say. We may suspend you immediately, without notice, where we reasonably think this is needed for safety, to prevent fraud, or because a required document has lapsed.

9.3 You may ask us to review a decision. We will reply in writing within 14 days.

9.4 We do not charge you penalties. If you fail to do a job you accepted, we may recover the actual, reasonable costs we incur as a result, such as the extra cost of finding another driver for that job.

9.5 If your access is removed or you stop using the platform, we will still pay the job fees you have earned for completed jobs, subject to the hold period and set-off in clause 6.

10. Customer data

10.1 You will receive customers' and recipients' names, addresses and phone numbers for the job. You must use them only to do that job, keep them secure, not share them, not contact the customer or recipient for any other purpose, and delete them (including from your phone) once the job and any dispute about it are over, and in any event within 30 days.

10.2 You must tell us straight away if you lose a device holding customer data or you learn of any unauthorised access to it.

10.3 We use your personal data as set out in our privacy policy. Location and photo data from the app helps us run the platform and prove deliveries.

11. Customers and our fee

11.1 You must not use a customer you met through a Hauly job to arrange a booking with you outside the platform, in order to avoid the platform's fee. This applies during the job and for 3 months afterwards.

11.2 You may tell people you are a driver who works with Hauly. You must not say or suggest you are Hauly's employee or that you speak on its behalf, and you must not use Hauly's name or logo, except as we allow.

12. Intellectual property

We own the app, website, branding and content. You may use the app only to do jobs for Hauly under these terms. You must not copy, reverse-engineer, scrape or misuse the platform.

13. Ending the relationship

13.1 You may stop using the platform and end these terms at any time by telling us. You must first complete or arrange substitution for any job you have accepted.

13.2 We may end these terms on 14 days' notice, or immediately if you seriously breach them or if clause 9.2 applies.

13.3 Clauses that are meant to continue (including clauses 6.4, 6.5, 7, 8, 10 and 11) continue after the terms end.

14. Changes to these terms

14.1 We may change these terms. We will give you at least 14 days' notice of a change that reduces your rights or increases your duties, through the app or by email. If you do not agree you may stop using the platform before the change starts. Your continued use after that date, or acceptance in the app, means you accept the new terms.

14.2 Some changes (for example a change to the hold period beyond what clause 6.3 allows) need you to accept the new version in the app before you can accept further jobs.

15. General

15.1 Entire agreement. These terms (and any extra terms under clause 1.2) are the whole agreement between us about the platform.

15.2 No partnership or employment. Nothing creates a partnership, joint venture, agency or employment.

15.3 Third parties. Nobody other than you and Hauly can enforce these terms.

15.4 Transfer. We may transfer our rights and duties under these terms to a business that takes over our service. You may not transfer yours except by sending an approved substitute under clause 5.

15.5 If part is invalid. If any part is unenforceable, the rest continues.

15.6 No waiver. If we do not enforce a right straight away, we can enforce it later.

15.7 Law and courts. These terms are governed by the law of England and Wales and the courts of England and Wales have exclusive jurisdiction.
